What we do with your personal information

We may collect personal information from you — such as your name, username, address, telephone number, email address, date of birth, and proof of ID — when you complete a registration or enquiry form, or email us, as well as through job information generated on the site, such as collection and delivery addresses. We may record any telephone calls made to the numbers listed on the Site. If you are a transport company, we also hold your bank details.

How we use your information

To administer your account, provide the products or services you have requested, and contact you about changes to them.
To reduce business risk — given the nature of our service, we collect certain data such as proof of insurance.
To assess lending risk, where you apply for credit on your LiftNGo account, by carrying out the necessary checks with credit reference agencies.
For audit purposes and to improve our service, using data generated by your use of it — such as customer comments and records of emails or telephone calls.
To contact you by electronic means, including email, telephone, and text message.
To record your insurance cover, for which we may collect proof of ID and proof of address.
To contact you about your renewal requirements when your insurance details are due for renewal.
To analyze use of our website for trends.

Our lawful grounds for processing

LiftNGo processes your personal information on the following grounds:

Performance of a contract — processing that is necessary for the contract between you and LiftNGo for use of the Platform.
Consent — where we process your data for direct marketing by electronic means (telephone, email, fax, and text message), we rely on your opt-in consent, which you can withdraw at any time by contacting us.
Legitimate interests (marketing) — where we send email marketing, we rely on our legitimate interest as a commercial organization; your rights are not unduly affected because you can still opt out (see “Your rights” below).
Legitimate interests (audit and improvement) — we retain information such as customer comments, emails, and telephone recordings to identify issues, improve the service, and keep an audit log of our interactions with you.
Consent (partners) — where we share your data with partners, we rely on the opt-in consent you have provided for that purpose.

Your choices

You can withdraw consent to electronic marketing at any time by contacting us, and you can opt out of direct marketing whenever you like — see “Your rights” below.

Disclosures and transfers

LiftNGo may pass your personal information on to the following recipients:

LiftNGo staff, in the course of their work.

Our insurance partners.

Auditors, contractors, and other advisers who audit or advise us on our business operations.

Law enforcement agencies and other government officials, where we believe it necessary or appropriate in connection with an investigation — we cooperate with law enforcement and other third parties to help enforce the law.

The other party to a dispute between Platform users: where we cannot resolve a job dispute and either side wishes to take the matter up directly, we provide the relevant contact details to the parties.

A successor or acquirer, where we transfer, sell, or assign personal information as part of a sale, merger, consolidation, change of control, transfer of assets, or reorganization of our business (or any part of our group).

Your rights in relation to your personal information

You have the following rights in relation to the personal information LiftNGo processes about you. Where you exercise a right, we will tell you what action we have taken — if any — within 30 calendar days of receiving your request, and explain our reasons where we have taken none.

Considering the complexity and number of requests, it may take us up to 90 calendar days to respond. Where we intend to extend that deadline, we will let you know within 30 calendar days of receiving your request.

Right of access

You can request access to the personal information LiftNGo holds about you.

Right to rectification

Where the personal information we hold about you is inaccurate, you can ask us to correct it. Considering the purposes for which it is processed, you can also ask to have incomplete information about you completed.

Right to erasure

In certain limited circumstances, you can ask us to erase personal information we hold about you. This applies only where one of the following is true:

We no longer need the information for the purpose for which it was obtained or used.
The processing was based on your consent, you have withdrawn that consent, and there is no other legal ground for processing.
You have objected to the processing and there are no overriding legitimate grounds for it.
You have objected to the use of your information for direct marketing.
The information has been unlawfully processed.
We are required to erase the information to comply with a legal obligation.

The right does not apply where processing your information is necessary for compliance with a legal obligation, for the performance of a task carried out in the public interest, or for the establishment, exercise, or defence of legal claims.

Right to restriction of processing

You can ask us to restrict the processing of your personal information where:

you have contested its accuracy — processing is restricted while we verify it;
the processing is unlawful and you have asked us to restrict its use rather than erase it;
we no longer need the information but you require it to establish, exercise, or defend legal claims; or
you have objected to processing — processing is restricted while we verify whether our legitimate grounds override yours.

Where processing is restricted, we will only store the information unless you consent to further processing, or it is needed to establish, exercise, or defend legal claims, to protect another person’s rights, or for reasons of important public interest. We will write to you before lifting any restriction.

Right to data portability

Where our grounds for processing are consent or the performance of a contract, and the processing is carried out by automated means, you can receive the personal information you have provided to us in a structured, commonly used, machine-readable format. You can also ask us to transmit it to another controller where technically possible.

Right to object to processing

You can object to the processing of your personal information at any time, on grounds relating to your particular situation, where our grounds for processing are legitimate interests or the performance of a task carried out in the public interest.

You can also object specifically to the processing of your personal information for direct marketing. If you do, we will stop processing it for that purpose.

Automated decision-making and profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects concerning you or similarly significantly affects you. This does not apply where the decision is necessary for entering into or performing your contract with LiftNGo, is authorized by law, or is based on your explicit consent.

Right to complain

If you believe LiftNGo has not properly complied with its obligations in respect of your personal information, including the rights set out above, you can complain to the Privacy Commissioner of Canada.
